In a major decision, the Supreme Court today ruled that the National Childhood Vaccine Injury Compensation Act of 1986 preempts state-law design-defect tort claims. The Court split 6-2, with Scalia writing for the majority; Justice Breyer concurred, and Justice Sotomayor dissented, joined by Justice Ginsburg. (Justice Kagan recused herself.)
