FORUM « Docs' apologies | Katrina litigation is still hot » November 8, 2007$60 Million Damages Award to Sleepy Driver Overturned As the Daily Business Review (via Law.com reports, Florida's very good 3rd District Court of Appeals has overturned a 2006 $60 million jury wrongful death verdict against Ford, where the decedent fell asleep at the wheel while driving his Explorer. Ford successfully argued that Miami-Dade Circuit Judge Roberto Pineiro erred by allowing testimony alluding to hundreds of Ford Explorer "rollover" accidents without requiring the plaintiffs to establish similarities between ordinary rollovers and cases where the driver falls asleep....
