There could also be new charges that Milberg Weiss faked costs for expert work, which would almost certainly resonate better with the jury than an arcane theory of kickbacks that the defendants will be able to muddy with for-hire experts who would testify that the kickbacks were realy referral fees that theoretically did not hurt anyone.
