John Boehner (R-Ohio), cites our discussion of loser-pays. Per Lamagna's account, McDermott is faced with the unfairness of defending a suit which falls under one of the many "one-way" fee provisions: he pays his adversary's fees if he loses, but has no right to collect fees if he wins.
