Judge Kathryn Ferguson entered an order last week authorizing a committee of Congoleum's bondholders to sue Gilbert Heintz for malpractice in the conflict-of-interest scandal over asbestos claims and pre-packaged bankruptcy (Feb. 20; Oct. 18 and links therein). The firm is already subject to a $9 million fine that might drive it under—though perhaps it could sell its $2.5 million plane.
