- I'm still not quite sure how I got typecast as the big supporter of Sotomayor around here -- I expect I'll disagree with her positions most of the time in close-fought cases, just as I tend to disagree with Souter's or Ginsburg's -- but at any rate I see that I'm in good company: Jonathan Adler at Volokh has written a new post ("Anti-Anti-Sotomayor") that almost exactly expresses my own feelings on the matter.
- "Legal Realist?" It takes more than "judges' backgrounds affect their decisions" to qualify as that [Rick Hills, Prawfsblawg]
- A "zealous prosecutor" seen by some, at least [L.A. Times], as "something of a law-and-order judge, especially when it comes to police searches and the use of evidence". Given the pervasive trend toward overcriminalization of American life and the pervasive dangers occasioned by prosecutorial zeal, let's not rush to score that as a "plus" without further inquiry.
