Patti Waldmeir of the Financial Times takes issue with Judge Posner on some questions of punitives and proportionality. Most noteworthy line: "Bedbugs notwithstanding, it is normally a very bad idea to punish defendants for hypothetical wrongdoing that has not been tried in court." (via Lattman).
